The Manifesting Frequency™ Program - - Tier 2: 6-Month Membership

TERMS OF PURCHASE:

This agreement is between Brooke-Sidney Harbour of Brooke-Sidney LLC (The Coach & Instructor) and Student/Purchaser (hereinafter "Client") for the purposes of outlining the terms and conditions for coaching and instruction with Brooke-Sidney J. Harbour.

I. Indemnity:
By engaging the Coach, the Client represents him or herself as a competent, effective individual who is fully able to make his/her own personal and business decisions and choices, including decisions and choices the Client may make as a result of this coaching and teaching process. The Client represents him or herself or her company as being able to operate fully, freely, and responsibly for all of the Client’s personal and business decisions and actions.  By confirming this agreement, the Client agrees that any actions she or her company takes as a result of the Coach’s input, coaching, speaking, training or development are the Client’s actions and the Client’s actions alone. The Client alone is responsible completely and fully for the outcomes, results and any liabilities that arise from taking those actions. The Client waives all claims that may arise against the Coach arising out of or with respect to any claims or lawsuits against the Client. This includes any and all liabilities or damages incurred by the Client related to any actions the Client takes or decisions the Client makes as a result of the Coach’s input, coaching, speaking, training, or development. The Client understands that this work is considered Coaching and not Counseling, Psychology or Psychiatry Services. This work is not medical in nature and is not intended to treat, prevent or cure any disease.

II. Copyright and Ownership:
The Client understands that all material presented in the course and in the coaching process are proprietary, copyrighted, and/or licensed by the Coach. The Client promises that any notes the Client takes will be for the Client’s personal and professional use only. The Client will not resell any of the course or coaching distinctions and material without the prior written consent of the Coach. Furthermore, the Client will not attempt to coach other individuals by using the principles and methodologies employed in the Course or the coaching relationship without the prior consent of the Coach.

III. Confidentiality:
The Coach agrees to treat the Coach/Client relationship as confidential. The Coach agrees to gain consent from the Client before using anything from the relationship as a testimonial. Unless agreed upon by the Client, all information exchanged is considered confidential. Likewise, all information shared in the Community is also considered confidential. Do not share other student’s information or results without their permission.

IV. Refunds:
The Coach does not offer refunds. Since, this is a digital course and program, there are no refunds.

V. Payments

Payments for the course and coaching must be paid for access. All payments auto-renew based on the membership term. If a Client’s payment method fails, the Client will lose access to the course and coaching program. If the Client fails to pay, the client will be removed from all digital courses associated with the coaching program.

VI. Coaching Sessions:
If the Membership plan includes 1:1 Coaching Sessions, the Client is responsible for scheduling his/her session. The Coach will provide the client with sessions during the timeframe of the purchased membership plan. If sessions are not completed within the set upon time frame, The Coach and the Client may choose mutually agreed upon times to complete remaining sessions within the 30 days thereafter.

VII. Course & Curriculum:
At this time, the program’s course and curriculum is located on Thinkific and the private community is on Facebook. However, the Coach reserves the right to change the platforms. Client will be notified of any changes within 30 days and provided full access to new platforms, if needed.

VIII. No-Show:
If the Membership plan includes 1:1 Coaching Sessions, the Client understands that it is her responsibility to book sessions with the Coach and reschedule 48 hours prior to the appointment. The Coach will provide access to an online calendar for booking. If Client reschedules more than twice or is a no-show (cancelling in under 48 hours) twice in a row, the Client will pay a $250 no-show/cancellation fee. 

IX. Applicable Laws

Both parties agree that this agreement shall be interpreted and governed by the laws of the state of California.
